    One Tide Charters is licensed to carry 12 passengers, however a minimum of four passengers is required. Tours can go ahead with less than four passengers, however an additional charge will apply.

    The following Terms and Conditions apply to all cruise expeditions and general charter of any vessel or tender operated by One Tide Charters. These Terms and Conditions affect your legal rights and are legally binding.

      1. RESERVATIONS
      To make a reservation One Tide Charters requires a completed Booking Confirmation form and signed Terms and Conditions form from each passenger to be returned with a 25% non-refundable deposit of the full booking amount (applies to individuals and whole boat or exclusive charters). The deposit is to be paid by direct debit or cheque. The balance is due a minimum of sixty (60) days prior to cruise departure. All cruise prices are in Australian dollars.

      Please note that bookings are valid for a maximum of seven (7) days without a deposit and completed booking confirmation form and signed Terms and Conditions form. After this time the seat/s will be released for sale.

      We recommend that clients book their flights and accommodation in Derby at the same time they commit to travel with One Tide Charters.

      2. ACCOMMODATION POLICY
      Passengers acknowledge at time of booking that accommodation on board the vessel, Kimberley XPlorer, is in a quality swag on a raised bed frame, on an open deck and not in private cabins. Bathroom facilities are shared.

      3. CANCELLATION & REFUND POLICY
      Passenger Cancellation
      a) If a passenger cancels within 60 days prior to departure or if a passenger fails to arrive for the cruise, 100% of the total value of the reservation is forfeited. No refund is issued. Passengers should refer to their travel insurance. One Tide Charters reserves the right to re-sell an unoccupied berth due to passenger cancellation.
      b) If a passenger cancels 60 days or more prior to departure, One Tide Charters will offer the option of a credit voucher to the value paid to be used within 24 months from the original cruise departure date. Should the passenger decide not to accept the credit voucher and cancel altogether 60 days or more prior to the cruise, the passenger will forfeit the 25% non-refundable deposit.

      Cancellation due to a Force Majeure
      If a cruise is suspended due to reasons outside of both the passenger’s control and the operator’s control such as Government restrictions, Native Title access, a pandemic (e.g. COVID-19) or other force majeure, One Tide Charters will defer the passenger’s trip up to 24 months from the date of the original cruise departure with no increase in cost. If a passenger chooses not to defer their trip and cancel due to a force majeure, the passenger will forfeit the 25% deposit.

      Operator Cancellation or Cruise Delay
      If the operator cancels the cruise prior to departure for operational reasons, the operator will refund the total fare paid. If the departure of the cruise is delayed/curtailed in excess of 24 hours, the operator will refund part of the fare paid on a pro rata basis less any accommodation, evacuation or relocation costs. One Tide Charters will endeavour to follow the cruise itinerary and the passenger accepts that the operator has the right to change the itinerary, the vessel or cancel the cruise as a result of a force majeure or prevailing inclement weather conditions. The passenger accepts that they may then not be entitled to any compensation.

      4. TRAVEL AND MEDICAL INSURANCE
      One Tide Charters strongly recommends passengers arrange suitable comprehensive travel insurance, which includes cancellation insurance at time of booking. Please ensure this includes medical evacuation and not just medical expenses. This acts as protection from any circumstance which may force you to cancel or leave an expedition whilst it is in progress. In the unlikely event of a medical evacuation while onboard please bring your travel insurance policy inclusive of medical evacuation or a valid credit card for payment. One Tide Charters accepts no responsibility for the actions of any other operator/carrier that results in not meeting a booking or deadline.

      5. LIABILITY CONDITIONS
      One Tide Charters provides remote adventure expeditions and cruises, and passengers may face dangers and discomfort. Should this happen, each passenger should be prepared for and accept the risks involved with a trip of this nature. While all due care is taken by One Tide Charters to avoid unnecessary risks, it is the passenger’s ultimate responsibility for damages or loss of personal property or any illness, injury or loss of life. One Tide Charters does not accept liability for losses, costs or out of pocket expenses suffered as a delay in delivery of services. One Tide Charters does not accept liability for any breach of contract resulting from or caused by force of nature, natural disaster, act of god or unforeseen circumstances.
      6. MEDICAL RISKS
      We strongly advise that you arrange comprehensive travel, cancellation and medical insurance at the time of booking. Passengers with any medical conditions or dietary requirements should also make them aware to One Tide Charters at the time of booking. If a medical condition is diagnosed after making the booking, passengers must make One Tide Charters aware of the condition as soon as possible after receiving medical confirmation and ascertain that they are fit to travel. Medical ailments or accidents during the trip should be reported to the captain immediately. Emergency evacuation is available for severe medical conditions, at the customer’s expense (see Travel and Medical Insurance conditions).
      7. PASSENGER HEALTH AND RESPONSIBILITY
      The passenger admits a full understanding of the nature and character of the vessel and the scope of the activities contemplated by the passenger during the cruise (including those related to off- vessel activities such as excursions in the vessel tenders, snorkelling and diving) and assures and undertakes to the operator: a) That they are in good health and will be able to undertake the cruise and contemplated activities; b) That they will purchase travel insurance sufficient to cover any limitation of liability against the operator; c) That they accept the risk that they may suffer from sea sickness; d) That they have disclosed any physical or mental disability requiring special attention or treatment at the time of the booking; e) That any charges incurred by passengers for medical reasons including but not limited to physicians, surgeons, hospitals, off-vessel accommodation, medication, diagnostic facilities, air ambulance evacuation or ground ambulance, shall be the sole responsibility of the passenger; f) For the safety and comfort of all passengers smoking is not permitted in/on the vessel except in nominated areas; g) The passenger agrees to indemnify the operator from and against all claims, costs, charges and fines or penalties arising as a result of any claim made against the operator in this respect.
      8. LIMITATION OF OPERATOR’S LIABILITY
      The liability of the operator to the passenger is limited with respect to both personal injury and damage to loss of property to the full extent permitted by law and in terms of these cruise ticket conditions. The operator accepts no responsibility of liability to the passenger for loss, death or delay of, or injury to any passenger. These cruise ticket conditions remain in effect for the period when the operator is under any responsibility to the passenger or the passenger’s property. One Tide Charters does not accept any responsibility if any passenger delays the cruise due to illness, injury or medical evacuation.
      9. EXPEDITION ACTIVITIES
      One Tide Charters will not be liable to passengers for any injury or damage, which occur during recreational activities. This includes those activities both on and off the main vessel and associated tenders.
